Two US senators, Chuck Grassley and Dick Durbin, have introduced a new bill called the H-1B and L-1 Visa Reform Act. This bill aims to make the visa system fairer, protect American workers, and give priority to highly skilled foreign workers.
Currently, H-1B visas are given through a random lottery. The new bill wants to replace this with a priority system. People with advanced STEM degrees from US universities will be given first preference.
Next will be other US advanced degrees, followed by bachelor’s degrees in STEM, and then other bachelor’s degrees. Employers offering higher wages will also get more priority.
The bill also introduces stricter rules for companies. Employers must post job details, including salary and qualifications, for at least 30 days before applying for an H-1B visa. There will be stronger penalties for companies that break the rules. Workers who report abuses will also be protected by law.
For L-1 visas, which are used for company transfers, the bill suggests more checks to stop misuse. It will also allow audits and place limits on certain visa uses.
Indians currently receive the majority of H-1B visas. With this change, preference may shift towards US-educated students and high-paying jobs, which could affect many Indian applicants.
This bill has only been proposed. It must pass in Congress and be signed by the President before becoming law.
