Restaurants across India are being reminded that imposing a mandatory service charge on customers is illegal. As per consumer rights guidelines, a service charge is entirely optional, even if it is printed on the menu or mentioned in the bill. Customers have the full right to decide whether they want to pay it or not.
Automatically adding a service charge and pressuring diners to clear the amount is considered a violation of the Consumer Protection Act, 2019.
Authorities have clarified that such practices amount to unfair trade behavior because they restrict a customer’s freedom of choice. A service charge cannot be disguised as a compulsory fee, nor can restaurants deny services or create uncomfortable situations if a customer refuses to pay it.
Consumers who face such issues can request the restaurant to remove the charge from the bill. If the establishment refuses, they can file a complaint with the National Consumer Helpline or approach the consumer commission for redressal.
The rule aims to ensure transparency in billing and protect customers from hidden or forced costs. While tipping for good service remains a personal gesture of appreciation, it must always be voluntary. Restaurants are expected to clearly communicate this and avoid misleading practices that could harm consumer trust and confidence in the dining experience.
