Many people believe that the validity date printed on a US visa decides how long they can stay in the country. However, US authorities have clarified that this is a common misunderstanding. The actual length of stay in the United States is determined not by the visa but by the US Customs and Border Protection officer at the port of entry.
A visa only allows a traveler to reach a US airport or border checkpoint and request entry. It does not guarantee entry into the country, nor does it fix the duration of stay.
When a traveler arrives, the CBP officer reviews the purpose of travel, documents, and background before deciding how long the person is allowed to remain in the US.
This permitted stay period is recorded in the I 94 Arrival and Departure record. The I 94 includes an “admit until” date, which is the final day the traveler can legally stay in the US.
Even if the visa is valid for several more years, overstaying beyond the I 94 date can lead to serious immigration issues, including future visa denials.
