Going into details, a man and woman who are in their 30s were in a relationship and became physical too. But the man could not marry the woman as his family did not approve. With this, the woman moved the High Court against the man saying that he raped her.
The petition went before the Bombay High Court. The Nagpur bench of the Court dismissed the petition and said that a man saying no to marriage as his parents did not approve cannot be seen as rape. On the occasion, the bench made some crucial comments.
The bench observed that both the man and woman became physical with mutual interest and the boy could not tie the knot as his parents did not approve. As there was no force in being physical, the bench said that it cannot be seen as rape and quashed the petition, and the an received a big relief.
During the arguments, the man told the bench that he wanted to marry the woman but he could not as his parents did not approve of the match. Citing the same, the bench asked what the man could do when his parents did not approve. On the same grounds, the petition was quashed and he was given a big relief.
