Big News For H1B Visa: No More 100K Fee?
A federal judge has struck down President Trump's requirement that employers pay a $100,000 fee for H-1B visa petitions.
The United States has largely changed its immigration policies in the recent past and the repercussions were felt by the Indian community to a large extent.
However, the latest developments are suggesting that there is some positive news for the Indian community in the United States as the recently imposed $100,000 fee by Trump is getting wiped away.
A federal judge has struck down President Trump's requirement that employers pay a $100,000 fee for H-1B visa petitions.
In a big ruling, District Judge Leo Sorokin held that the President lacked the authority to impose the fee, stating that only Congress can make such a change to federal immigration policy. The judge described the requirement as a tax and wrote:
"The President had no power or delegated authority to impose a tax on H-1B petitions." The policy had been imposed several months earlier as part of an effort to curb what the administration said was overuse of the H-1B program.
H-1B visas allow highly skilled foreign professionals with at least a bachelor's degree or equivalent to work in specialized occupations in the United States, typically for three years with the possibility of renewal.
This could prove to be extremely good news to the Indian community as the removal of the fee that was imposed by Donald Trump would be helping multiple other skilled Indians to get jobs in the US.
