Madras High Court has recently ordered that watching and downloading child p*rnography is not a crime if it is just for storage. But the Supreme Court set it aside and claimed that having such content in itself is a crime according to the Protection of Children from S*xual Offences Act (POSCO).

Justice JB Pardiwala says, "The HC committed an error in its order and thus we set aside the HC order and we remit the matter back to the sessions court.” The Supreme Court ordered everyone to use ‘Child S*xual Exploitative and Abusive Material' instead of child p*rnography.

He said, "We have suggested to the parliament to bring an amendment to POCSO...so that the definition of child p*rnography can be referred to as child s*xually abusive and exploitative material. We have suggested an ordinance can be brought in. We have asked all courts not to refer to child p*rnography in any orders."
