An interesting petition reached the High Court filed by a husband challenging the orders of a lower court. Hearing the petition the High Court made some crucial comments on the marriage system in the country and the responsibilities the daughter-in-laws have. The Court also cited the reference from popular books.
Going into details one Piyali Ray Chatterjee moved a court seeking maintenance for her and her son from her husband. The family court gave orders in her favour and ordered her husband Rudra Narayan Ray to pay the maintenance for Piyali.
Having faced a big shock with this, the husband moved the High Court challenging the orders. The petition was placed before the bench of Justice Subhash Chand. After the hearing, the justice made some crucial comments on the responsibility of wife and daughter-in-law.
The woman alleged that she was pressured for a dowry and she went through a big pressure. However, her husband rubbished the claims and said that she put pressure on him to send his mother and grandmother out of the house.
The Court found that the woman didn’t want to look after her mother-in-law and her mother. With this, the Court made some crucial comments and gave the example of Manu Smriti and other books.
Drawing a comparison between marriages in India and the West, the Judge said that in the West sons get separated from the house after the marriage but that is not the case in India.
Talking about the tradition, the Judge said that looking after the elders has been the tradition and if women get separated from their husbands without reason then they are not eligible to get the maintenance.
Citing scripts like Manusmriti and Vedas, the Judge said that serving an aged mother-in-law or grandmother-in-law is the culture and the wife should preserve the culture.
