High Court served notices to four YSR Congress Legislators who have been serving as Cabinet Ministers of AP CM Chandrababu Naidu. Ministers Bhuma Akhila Priya, N Amarnath Reddy, Sujay Krishna Ranga Rao and Adinarayana Reddy were asked to file counter affidavit within 4 Weeks.
Justice Ramesh Ranganathan and Justice T Rajani accepted the petition filed by Siva Prasad Reddy against induction of YCP MLAs into TDP Cabinet. Petitioner's Counsel Anand Kumar argued that defector Lawmakers can't continue in their posts as per 10th Schedule of the Constitution. 'Defector MLAs serving as Ministers is violation of 164 (1b) of the Constitution. CM have the right to induct anybody into his Cabinet. But here, Opposition Legislators have been taken into cabinet and Governor approved it by holding Swearing-in Ceremony. This is against the Constitution,' he added.
AP Government Advocate General D Ramesh pointed out a petition on appointment of TDP MLA Talasani Srinivas Yadav as TRS Minister was moved in 2015 itself. Subsequently, High Court informed hearing of all petitions related to defector MLAs will happen at once. An order has been passed to High Court registrar in this regard.
